Client: any professional or individual with legal capacity within the meaning of articles 1123 and following of the French Civil Code, or any legal entity, who visits the Site governed by these terms and conditions.
Services: https://www.lesjardinsdelavalette.com provides Clients with a set of services related to bio-intensive market gardening (training, resources, content).
Content: all elements making up the information available on the Site, including texts, images and videos.
Client information: hereinafter referred to as "Information", these correspond to all personal data potentially held by https://www.lesjardinsdelavalette.com for the management of your account, the customer relationship and for analysis and statistical purposes.
User: any internet user connecting to or using the aforementioned site.

02Terms of use
The Site constitutes an intellectual work protected by the provisions of the French Intellectual Property Code and applicable international regulations. The client may not, in any way, reuse, transfer or exploit for their own account all or part of the elements or works of the Site.
Use of the site implies full acceptance of the terms of use described herein. These terms may be modified or supplemented at any time; users are invited to consult them regularly.
This website is normally accessible to users at all times. An interruption for technical maintenance reasons may, however, be decided, in which case efforts will be made to inform users in advance of the dates and times of the intervention.
02·BTerms of Service
Purpose. These Terms of Service govern all transactions concluded between Les Jardins de la Valette and any natural or legal person (hereinafter "the Client") wishing to acquire a training program, gift card or package offered on the website lesjardinsdelavalette.com.
Professional training
Pricing. Training prices are shown in euros (incl. VAT) on the dedicated pages.
Registration. Registration for a session becomes effective upon receipt of the complete file (signed training agreement) and at the latest 7 days before the start date. Any registration is validated upon receipt of payment.
Payment terms. Payment may be made in full or spread over up to 3 installments at no extra cost. Bank details are provided when registration is confirmed.
Withdrawal. In accordance with article L.221-18 of the French Consumer Code, the Client has a period of 14 days from the signing of the contract to exercise their right of withdrawal, without having to justify their decision. Beyond this period, and once training has started, no refund will be granted.
Cancellation by the provider. Les Jardins de la Valette reserves the right to cancel or postpone a session if the minimum number of participants is not reached, or in any case of force majeure. In such a case, sums paid are fully refunded or carried over to a later session at the Client's discretion.
Access to content. Online educational content (videos, fact sheets, downloadable plannings) is accessible via the Le Cercle platform throughout the validity period of the training, and access is strictly personal. Any reproduction, sharing or commercialization is strictly forbidden (see article 05 — Intellectual property).
Gift cards and packages
Validity. Gift cards and packages are valid for 12 months from their date of purchase. After this period, they cannot be refunded or extended unless exceptional agreement is reached.
Use. Gift vouchers are nominative and may be used for any service offered by Les Jardins de la Valette up to the amount indicated on the voucher. No change is given.
Withdrawal. The Client has 14 days to exercise their right of withdrawal from the date of purchase, provided that the voucher has not been used.
Complaints and mediation
Any complaint must be sent by registered mail to: Les Jardins de la Valette, 520 route de la rivière, 12200 Sanvensa, or by email to contact@lesjardinsdelavalette.com. Failing an amicable agreement, the Client may free of charge refer the matter to the consumer ombudsman (CNPM Médiation — cnpm-mediation-consommation.eu).
Any dispute relating to these Terms of Service is subject to French law and falls within the exclusive jurisdiction of the courts of Rodez.
03Description of the services provided

04Contractual limitations on technical data

It nevertheless reserves the right to interrupt the hosting service for the shortest possible periods.
Neither we nor the host can be held responsible in case of malfunction of the Internet network, telephone lines or computer and telephone equipment, in particular linked to network congestion preventing access to the server.
05Intellectual property and infringement
Les Jardins de la Valette owns the intellectual property rights and holds the rights of use over all the elements accessible on the website, in particular the texts, images, graphics, logos, videos, icons and sounds. Any reproduction, representation, modification, publication or adaptation of all or part of the elements of the site, regardless of the means or process used, is prohibited without our prior written authorization.
Any unauthorized exploitation of the site or any of the elements it contains will be considered as constituting an infringement and prosecuted in accordance with the provisions of articles L.335-2 and following of the French Intellectual Property Code.
06Liability limitations
Les Jardins de la Valette acts as the publisher of the site and is responsible for the quality and accuracy of the Content it publishes.
We cannot be held liable for direct and indirect damage caused to the user's equipment when accessing the site, resulting either from the use of equipment that does not meet the specifications indicated in point 4, or from the appearance of a bug or incompatibility.

7.1 Personal data collection controller

In this case, the User must indicate the Personal Data that they wish us to correct, update or delete, identifying themselves precisely with a copy of an identity document (ID card or passport).
Users may also lodge a complaint with the supervisory authorities, in particular the CNIL.
7.4 Non-disclosure of personal data
We refrain from processing, hosting or transferring Information collected on our Clients to a country located outside the European Union or recognized as "inadequate" by the European Commission without first informing the customer. We remain free to choose our technical and commercial subcontractors on condition that they offer sufficient guarantees with regard to the requirements of the GDPR.
We undertake to take all necessary precautions in order to preserve the security of the Information and in particular to ensure that it is not communicated to unauthorized persons. Furthermore, we do not collect any "sensitive data".
08Incident notification
